Terms of Business

These Terms of Business govern your use of our website and the services we provide, including business funding applications and related support for UK professional practices. By using our website or engaging with our services, you agree to be bound by these Terms.

1. About us

Practice Capital (www.practicecapital.co.uk) is a trading style of Capital Business Loans Limited, a limited company registered in England with company number 14491729, whose registered office is at Suite 31, Shiftworks, 14 Upper Northgate Street, Chester, CH1 4EE. We are registered with the Information Commissioner's Office under reference ZB464621. Capital Business Loans Limited is authorised and regulated by the Financial Conduct Authority under firm reference number 1000382.

We are an independent business finance brokerage. We aim to secure funding offers for your practice from a panel of business lenders across the UK. We are a brokerage and not a direct lender.

2. Definitions

  • "You" or "your" — the individual or entity accessing our website or services, including any authorised representatives.
  • "Services" — all services provided by Practice Capital, including funding application processing, finance consultations and related support.
  • "Website" — www.practicecapital.co.uk and any associated subdomains.

3. Eligibility

To use our Services, you must:

  • Be a business, partnership, practice or sole trader registered and operating in the United Kingdom
  • Be an individual with a UK address, at least 18 years old, acting for purposes within your trade, business or profession
  • Provide accurate and complete information during the application process
  • Comply with all applicable laws and regulations, including those relating to financial services

4. Our services

  • Funding application processing — facilitating applications for working capital, tax and VAT funding, PII premium finance, asset finance, lines of credit, refinancing and growth funding through our lender network.
  • Brokerage services — acting as an intermediary between you and third-party lenders, including support during the application process to ensure a quick and smooth decision.
  • Documentation support — liaising between you and the lender to ensure the smooth processing of any paperwork that needs completing.

We do not guarantee approval, as decisions are made by third-party lenders against their own criteria. Some lenders may provide an initial quote or indicative offer, which is not a full offer of finance. All indicative offers are subject to final checks before a full offer is issued. We will always act in your best interests to match your practice with the most appropriate and available funding offer from our panel.

5. Your obligations

When using our Services, you agree to:

  • Provide accurate, current and complete information during the application process and when communicating with us
  • Notify us promptly of any changes to your practice, personal or financial circumstances that may affect your application
  • Use our website and Services only for lawful purposes and in compliance with these Terms
  • Not misuse our website, including by introducing viruses or malware, or engaging in fraudulent activity

6. Application process

Submission

You may apply through our website or by contacting us directly by phone, email or WhatsApp. Applications require submission of financial and practice information, which we will share with lenders. Lenders will also require personal information for principals, partners, directors and major shareholders — usually full name, date of birth, contact details and address history.

Assessment

We review your information before submitting any funding applications to the most relevant lenders.

Documentation

The minimum we require is basic financial information on your practice and principal or director details. Most applications require your latest full accounts and last 3–6 months of business bank statements. Some applications may require further information such as management accounts, VAT returns, HMRC debt information and cash flow forecasts.

Decision timeframes

We work with a variety of lenders. Some can offer instant decisions; others may require a few working days to a couple of weeks. Secured facilities can take longer. We will always keep you up to date on how long the decision process with each lender is likely to take.

Credit checks

We may carry out identity and credit checks on each practice to help detect and prevent fraud. These checks may include credit checks on the business and its owners or directors, which are visible on your credit report but do not impact your credit rating. You agree that we may use the data you provide for these purposes, as more fully described in our Privacy Policy. Lenders will also carry out credit checks to provide a full offer; these may be soft or hard searches on the practice or the individuals listed on the application.

7. Third-party lenders

  • We work with a panel of third-party lenders to find suitable funding options for your practice
  • Facility terms, interest rates and repayment schedules are determined by the lender and set out in a separate agreement between you and the lender
  • We are not a party to that agreement and are not liable for any disputes arising between you and the lender
Security and personal guarantees
Most unsecured facilities require personal guarantees from principals, partners or directors, and secured facilities require charges over property or business assets. We strongly recommend taking independent legal advice before signing any guarantee or security document.

8. Fees and payments

Finance providers pay us commission for introducing businesses that proceed with funding offers. This commission varies by provider depending on the facility arranged, and may be a fixed fee or a fixed percentage of the amount you borrow.

9. Intellectual property

  • All content on our website — text, logos, images and software — is owned by or licensed to Capital Business Loans Limited and protected by intellectual property laws
  • You may not copy, reproduce, distribute or modify any content without our prior written consent

10. Limitation of liability

  • No guarantee — we do not guarantee approval, the availability of specific terms, or the suitability of any facility for your needs.
  • Indirect losses — to the fullest extent permitted by law, we are not liable for indirect, consequential or incidental losses (for example loss of profits, business or data) arising from your use of our Services or website.
  • Website use — we are not liable for losses caused by errors, downtime or unavailability of our website.

11. Indemnity

You agree to indemnify and hold us harmless from any claims, losses or damages arising from your breach of these Terms, misuse of our Services, or violation of any laws.

12. Termination

  • We may suspend or terminate your access to our Services or website if you breach these Terms or for any other lawful reason
  • You may stop using our Services at any time by ceasing to access our website or contacting us to withdraw your application

13. Confidentiality

We will treat your personal and practice information as confidential in accordance with our Privacy Policy. However, we may disclose information to lenders, regulators, or as required by law.

14. Governing law and jurisdiction

These Terms are governed by the laws of England and Wales. Any disputes arising from these Terms or our Services will be subject to the exclusive jurisdiction of the courts of England and Wales.

15. Changes to these terms

We may update these Terms to reflect changes in our Services, business practices or legal requirements. We will notify you of significant changes by posting the updated Terms on our website with a revised "last updated" date.

16. Force majeure

We are not liable for delays or failures in providing Services due to events beyond our reasonable control, such as natural disasters, regulatory changes or technical failures.
